These Terms of Service ("Terms") govern your access to and use of PlowPaths (the "Service").

PlowPaths is operated by Adam Heaton, an individual ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

PlowPaths provides software tools for mapping properties, recording measurements, organizing site information, and generating snow-plowing quotes.

The Service is provided for general informational and operational purposes only.

2. No Professional Advice or Guarantees

All measurements, calculations, pricing outputs, and recommendations generated by the Service are estimates only.

You are solely responsible for:

  • Verifying the accuracy of measurements and data
  • Determining appropriate pricing
  • Ensuring compliance with applicable laws, regulations, and contracts

We do not guarantee the accuracy, completeness, or suitability of any output produced by the Service.

3. User Responsibilities

You agree to:

  • Use the Service lawfully and responsibly
  • Maintain the confidentiality of your account credentials
  • Accept full responsibility for how quotes, measurements, and outputs are used or shared

You are responsible for all activity that occurs under your account.

4. Subscriptions and Payments

Some features of the Service require a paid subscription.

Subscription fees are billed in advance and renew automatically unless canceled.

Billing and payment processing are handled by our third-party provider, Stripe.

Prices, billing intervals, and features may change with notice.

Refunds are not guaranteed and are evaluated on a case-by-case basis.

You may cancel your subscription at any time through your account settings.

5. Free Plans and Usage Limits

Free plans may include usage limits. We reserve the right to enforce, modify, or remove free plan limitations at any time.

Attempts to bypass usage limits are prohibited.

6. Account Suspension or Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Misuse or abuse the Service
  • Engage in unlawful or harmful behavior

We may do so without prior notice.

7. Deleting Your Account

You may request account deletion from your account settings by completing our confirmation step.

When processed, we cancel active Stripe subscriptions associated with your account and archive account records in our systems.

Account archival does not guarantee deletion from all backups immediately. Backup-retention timelines vary by system and provider.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available."

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Lost profits
  • Lost business opportunities
  • Indirect, incidental, consequential, or special damages
  • Damages arising from reliance on Service outputs

Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Vermont, without regard to conflict of law principles.
